Dedicated Attorneys for Pedestrian Accidents in New Jersey

Nationally, pedestrians account for more than one in ten traffic fatalities, and in New Jersey pedestrian injuries and deaths occur at a higher rate than the national average. Motorists have a duty to drive carefully, and that duty includes looking out for pedestrians on the street. When pedestrians are hurt or killed in traffic accidents because of a negligent, reckless or distracted driver, the injury attorneys at Massood & McCluskey in Wayne are here to help accident victims and their families recover the compensation they need and hold the drivers accountable for their negligence.

New Jersey Driving Laws Designed to Prevent Pedestrian Accidents

Section 39:4-36 of New Jersey statutes requires drivers to yield the right-of-way to pedestrians who are crossing the roadway at any unmarked crosswalk at an intersection. Drivers must do more than just slow down for pedestrians crossing the street in a marked crosswalk. Drivers must stop and stay stopped to allow the pedestrian to cross. This requirement lasts for as long as the pedestrian is on the same side of the street/same half of the roadway as the vehicle, and just before or after they cross that point.

Violation of this law can result in a $200 fine plus court costs for the offender, as well as 15 days of community service, insurance surcharges, and two points on the person’s driver’s license. Even more significant, a motorist who violates this law and injures a pedestrian may be negligent per se under the law and liable to the accident victim for medical expenses, lost wages, pain and suffering, and other legal damages.

Help is Available for Victims of Pedestrian Accidents in Wayne, NJ

Pedestrians have a duty to be attentive and careful when crossing the street. It is against the law for a pedestrian to suddenly walk or run into the path of a vehicle where it is impossible for a driver to yield, and pedestrians must yield the right-of-way to cars when not in a crosswalk. Yet for all their care and attention, there is little a pedestrian can do when a driver is speeding, texting while driving, refusing to stop at a stop sign or red light, or failing to check for pedestrians before turning in an intersection.
